Motherland Legal Consultancy Center (“we”, “us”) is a legal consultancy based at 3rd Floor, Putalisadak Business Complex, Kathmandu, Nepal. This policy explains what personal information we collect when you use this website or engage our advisors, why we collect it, how long we keep it and the choices you have. It applies alongside our professional obligations under the Nepal Bar Council Rules and the Privacy Act, 2075 (2018).
1. Information we collect
We collect information in three ways.
- Information you give us directly. Your name, phone number, email address, the area of law your enquiry relates to and the details you type into the contact form, consultation booking or Ask Legal Guide tool. If you engage us, we will also collect identity documents, citizenship or passport details, contracts, court papers and any other documents needed for your matter.
- Information collected automatically. Standard server logs (IP address, browser type, pages visited, time of visit) used for security and to keep the site working. We do not use advertising trackers.
- Information stored on your device. Small preferences such as your theme choice, recent searches and unfinished tool drafts. See our Cookie Policy for the full list.
2. How we use your information
- To respond to enquiries and schedule, confirm and conduct consultations.
- To provide legal services once you have signed an engagement letter, including drafting, filing and correspondence with courts, government offices and opposing parties.
- To issue invoices and keep accounting records required by Nepali tax law.
- To run conflict-of-interest checks before accepting a new matter.
- To send legal updates by email, only if you have subscribed. Every email includes an unsubscribe link.
- To detect misuse of the site and keep it secure.
We do not use your information to build advertising profiles and we never sell it.
3. Confidentiality and privilege
Anything you share with an advisor in connection with seeking legal advice is treated as confidential and, where the law allows, protected by advocate-client privilege. This applies from your first contact with us, whether or not you go on to engage us. Support staff who see your information are bound by the same confidentiality obligations as our advocates.
4. Storage and security
Client files are stored in access-controlled case-management systems with encryption in transit and at rest. Physical files are kept in locked storage at our Kathmandu office. Access is limited to the advisor responsible for your matter and the staff supporting them. We review access rights regularly and log access to sensitive records.
No system is perfectly secure. Until secure upload storage has been configured for your matter, we ask that you avoid sending highly sensitive documents such as full bank statements or passwords through the website.
5. Sharing with courts, authorities and third parties
We share personal information only when it is necessary to act for you or when the law requires it:
- Courts, tribunals, the Office of the Company Registrar, Land Revenue Offices, the Department of Immigration and other authorities, as needed to progress your matter.
- Opposing parties and their advocates, limited to what the procedure requires.
- Service providers who host our systems or process payments, under written confidentiality terms.
- Where a court order or a statutory duty compels disclosure. We will tell you before complying unless we are legally prevented from doing so.
6. How long we keep your information
Enquiries that do not lead to an engagement are deleted after 12 months. Client files are kept for at least seven years after a matter closes, in line with limitation periods and record-keeping duties, after which they are securely destroyed unless you ask us to return them. Accounting records are kept for the period required by the Income Tax Act, 2058.
7. Your rights
You can ask us at any time to:
- confirm what personal information we hold about you and receive a copy;
- correct information that is inaccurate or out of date;
- delete information we no longer need to keep for legal or professional reasons;
- stop sending you legal updates or marketing emails.
We respond to requests within 15 working days. Some requests may be limited by our duty to keep client records.
8. Cookies and local storage
This site uses a small number of functional cookies and browser storage items to remember your preferences. We do not use advertising or cross-site tracking cookies. Details are in the Cookie Policy.
9. Children
Our services are directed at adults. If a matter concerns a child, we collect the child's information only through a parent or legal guardian.
10. Changes to this policy
We may update this policy when our practices or the law change. The date at the top of the page shows when it was last revised. Significant changes will be announced on the website.
11. Contact
